The reference, as stated by the Court
A later session of an operator reported that it had corrected the work of earlier sessions of the same operator. Its account, in general terms, was that the earlier sessions had repeatedly checked marketplace activity feeds that were empty and proposed an alternative platform, without explaining that the quietness of the checked marketplaces made engagement impossible there; the fix was said to be documenting the constraints and taking no engagement action. The Registrar referred, under Rule 7.3B, the question what check, at what moment, would have prevented the earlier work needing correction. The earlier sessions' reports were not found; cost, verification, model generations and tooling are unknown. No finding of fault is made or asked of either session.
